  1. General Terms and Conditions
    These Terms and Conditions apply to all agreements between Sim-Lab USA Inc (“we,” “our,” or “us”) and our customers (“you” or “Customer”) for the purchase of products from our online store. By placing an order, you agree to these Terms and Conditions. Any conflicting terms from the Customer will only apply if explicitly accepted in writing by Sim-Lab USA Inc. We reserve the right to amend these Terms and Conditions at any time with reasonable notice.

  2. Offer
    Products listed on our website are for informational purposes only and do not constitute a binding offer. Minor deviations in product images or descriptions may occur.

  3. Prices and Taxes
    All prices are listed in USD. Applicable U.S. sales tax will be calculated at checkout based on your shipping address. Shipping costs are additional unless otherwise stated. Coupons, discounts, or promotional offers are only valid if explicitly stated and cannot be combined unless indicated.

  4. Conclusion of a Contract
    By placing an order, you make a binding offer to purchase the relevant product(s). We will send an order confirmation via email upon receipt of your order, but the purchase contract is only formed when the products are shipped or delivered. By placing an order, you confirm that you are at least 18 years old.

  5. Payment
    Payment is due immediately upon placing an order. We accept credit and debit cards (Visa, Mastercard, American Express), PayPal, Apple Pay, and Klarna (if available at checkout). Any bank or transaction fees are the responsibility of the Customer.

  6. Shipment and Delivery
    All orders are fulfilled from Pennsylvania, USA. Orders are shipped via standard carriers and may be delivered in multiple packages. Special shipping requests may incur additional fees. If packages are delayed or damaged during shipping, the Customer must contact Sim-Lab USA Inc support for assistance. Investigations with carriers may take several business days.

  7. Delivery Times
    Products that are in stock are shipped within 1-5 business days after receipt of payment. Delivery times may be extended due to circumstances beyond our control, including suppliers, carriers, natural disasters, or holidays. If a product cannot be delivered within two (2) months of the agreed date due to supplier or manufacturing issues, either the Customer or Sim-Lab USA Inc may cancel the order. Claims for damages due to delay are excluded except as required by law.

  8. Return and Refund Policy
    The Customer may return unused products within fourteen (14) days of delivery. Return shipping is the responsibility of the Customer unless the product is defective or incorrectly shipped. Returned items must be in original and mint condition to qualify for a refund. Refunds will be issued to the original payment method once the product is inspected. Custom or cut-to-size products cannot be returned. If a product is delivered damaged, the Customer must document the damage and contact Sim-Lab USA Inc support. In such cases, return shipping will be arranged by Sim-Lab USA Inc.

  9. Passing of Risk
    The risk passes to the Customer upon delivery. For returns, the Customer bears the risk of loss or damage during shipment.

  10. Guarantee
    Sim-Lab USA Inc guarantees that the purchased products are free from material and manufacturing defects at the time of delivery. Minor scratches or marks on industrial-grade aluminum profiles are not considered defects. Customers must inspect products immediately upon receipt and report any apparent or latent defects within ten (10) days. The guarantee does not cover damage caused by improper use or handling. The guarantee period is twenty-four (24) months from shipment, except for seats which are covered for twelve (12) months.

  11. Reservation of Title
    Sim-Lab USA Inc retains ownership of all delivered products until full payment is received.

  12. Storage of Data
    All personal information is treated confidentially. Personal information may only be shared with service providers necessary for processing the order, such as shipping companies or payment processors. We do not sell personal data.

  13. Limitation of Liability
    Use of this website and purchase of products is at the Customer’s own risk. Sim-Lab USA Inc is not liable for indirect, incidental, or consequential damages except as required by law. While we take care to ensure the website is accurate and complete, we do not guarantee continuous availability or error-free content.

  14. Place of Execution and Legal Venue
    These Terms and Conditions are governed by the laws of the State of Delaware, USA. Any disputes will be exclusively handled in Delaware courts.

  15. Severability Clause
    If one of these provisions is found to be invalid or unenforceable, the remaining provisions shall remain in full force. A legally enforceable provision that most closely reflects the intent of the invalid provision shall replace it.

  16. Force Majeure
    Sim-Lab USA Inc is not liable for delays or failures caused by events beyond our control, including natural disasters, strikes, supplier issues, carrier disruptions, or technical maintenance.

  17. Disclamer

The use of this website is at the user’s own peril and risk. We neither accept liability for constant availability nor for the published contributions, offers and services with regard to accuracy, completeness and functionality. The guarantee is in accordance with the statutory provisions. Any liability for damage arising directly or indirectly from the use of this website is excluded. This website and the services associated with it are operated with the greatest possible care, reliability and availability. However, for technical reasons, it is not possible for these services to be constantly accessible, for the desired connections to always be successfully established or for the stored data to be retained in all circumstances. Therefore, constant availability cannot be guaranteed. Sim-Lab USA Inc undertakes to constantly check the On-Line Shop in order to avoid errors or inaccuracies. However, it is possible that the On-Line Shop contains, or may contain, errors, inaccuracies and/or omissions. Sim-Lab USA Inc therefore reserves the right to correct errors, inaccuracies and/or omissions in the On-Line Shop, even after an Order has been submitted, and also reserves the right to change and/or update information at any time, without giving prior notice to Customers. IP connectivity to other network operators occurs to the extent possible. Any liability for problems attributable to the networks of third parties is excluded. The use of other networks is subject to the conditions of use of the relevant operators.
